City can be sued under Coastal Act for failing to police surfer gang

“Conspiracy liability is not limited to tort; defendants may be liable if they agree to engage in conduct that violates a duty imposed by statute,” a 2nd District Court of Appeal panel concluded.

The City of Palos Verdes Estates can be sued for conspiracy to violate the Coastal Act because it failed to police a group of local surfers who menaced outsiders and built an unpermitted "fort" from which they based their illegal activities for nearly 40 years, a state appellate court panel ruled.
