Panel revives insurance company claim against Miller Barondess
The unpublished ruling said that the lower court erred in concluding that Section 533 of the California Insurance Code did not apply because there was no final adjudication that the law firm engaged in malicious prosecution.




The 9th Circuit Court of Appeals has reversed and remanded a Central District decision dismissing Aspen Specialty Insurance Company’s complaint that Miller Barondess LLP engaged in malicious prosecution.
The unpublished ruling on Thursday said that the lower court erred in concluding that Section 533 of the California Insurance Code did not apply because there was no final adjudication that the law firm engaged in malicious prosecution.
