More business interruption insurance cases go to high court

“These cases have ramifications that go far beyond the COVID-19 context,” said Andrew F. Kirtley of Cotchett, Pitre & McCarthy.

The state Supreme Court has agreed to consider two more cases about whether insurance companies may be liable to cover losses incurred by a business that was forced to close during the COVID-19 pandemic.

The court already had agreed to answer a certified question from the 9th U.S. Circuit Court of Appeals in a separate dispute between a policyholder and its insurance company.
