Lawyers ponder lower award from 2nd Tesla worker race trial

Plaintiff Owen Diaz’s attorneys said after the verdict that one possible reason for the lower award was the fact that the first jury had an African American on it who could share their perspective and life experience with their fellow jurors while the second jury, while still racially diverse, had no Black members.

Following the jury award of $3.2 million for the emotional distress a former Tesla Inc. subcontractor suffered facing rampant racial harassment while working at the automaker’s Fremont factory, legal experts weighed in Tuesday on factors that led to the substantially lower award the plaintiff received after he was awarded $137 million by a prior jury in 2021.
