US judge refuses to grant class status to protestors suing San Jose police

Senior U.S. District Judge Phyllis J. Hamilton ruled that because the NAACP brought claims not only against police leadership but also the individual officers that wielded allegedly excessive force, “the cross-cutting, non-overlapping nature of the various claims” prevented her from concluding the defendants’ conduct applied generally to the class.

A federal judge on Friday denied class status to a group of protesters who claimed police in San Jose used unnecessary force during a May 2020 demonstration.
