Monster gets permanent injunction against Vital

Monster said Vital Pharmaceuticals falsely claimed to potentially billions of people its BANG is superior to other energy drinks because it contained “super creatine,” a form of creatine that was able to retain its benefits in a liquid form when the compound is supposedly a powder not soluble in water.

Monster Energy Co. obtained a permanent injunction Wednesday against rival energy drink manufacturer Vital Pharmaceuticals Inc., arguing that even after the largest Lanham Act award in history, Vital Pharmaceuticals continued to make false statements about its drinks containing a special compound called “super creatine.”
