Judge dismisses some price fixing claims against StarKist
“[T]he [direct action plaintiffs] have failed to come forth with ‘specific evidence tending to show that [the defendants were] not engaging in permissible competitive behavior’ with respect to the downsizing of their tuna cans,” wrote U.S. District Judge Dana M. Sabraw.




A federal judge in San Diego dismissed some price-fixing claims against StarKist, its former U.S.-based parent company, and its current South Korean owner in multidistrict antitrust litigation against the food manufacturers.
StarKist was owned by Del Monte Foods until 2008 and has since been owned by Dongwon Industries. All three companies have been accused of fixing packaged tuna prices in a multidistrict lawsuit filed in 2015.
