Facebook can’t arbitrate woman’s bias claims

Judge Curtis E.A. Karnow rejected Facebook’s claim that the former product manager was attempting “to shoehorn her complaint into the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act.”

A lawsuit filed by a former female product manager claiming wrongful termination from Facebook Inc. will not be sent to arbitration after a San Francisco judge ruled Friday that the plaintiff adequately pleaded allegations of sexual harassment and discrimination by the company.

The plaintiff claims that her October firing was done in retaliation for raising concerns of sexual harassment and discrimination in the workplace.
