Kohl’s ceramic planters alleged to contain toxic chemicals

The lawsuit was filed under the California’s Safe Drinking Water and Toxic Enforcement Act of 1986, which was passed by voters as Proposition 65. The statute has been a lightning rod for criticism by defense attorneys.

A lawsuit filed this week in San Francisco Superior Court alleges that Kohl’s Inc., one of the nation’s largest retail chains, failed to warn customers of the presence of two toxic chemicals in its ceramic planters.

The lawsuit was filed under the California’s Safe Drinking Water and Toxic Enforcement Act of 1986, which was passed by voters as Proposition 65. The statute has been a lightning rod for criticism by defense attorneys.
