Most noncompete agreements are illegal, NLRB says

Attorneys who handle such disputes say the latest move, following a U.S. Federal Trade Commission proposal in January to ban noncompete agreements nationwide, is noteworthy but may not have a major impact in most cases — at least not yet.

The Biden administration’s assault on noncompete agreements continued Tuesday, as the general counsel of the National Labor Relations Board wrote a memo to regional directors of the agency saying most such deals violate the National Labor Relations Act.
