9th Circuit axes $1.7M fee award in Rhapsody copyright action
The panel remanded the case to Senior U.S. District Judge Jeffrey S. White of Oakland to “rigorously evaluate the actual benefit provided to the class and award reasonable attorneys’ fees considering that benefit.”




A 9th U.S. Circuit Court of Appeals panel reversed a $1.7 million grant of attorney fees to lawyers for musicians who sued Rhapsody International Inc. in a copyright class action and won an award of a little more than $50,000.
The panel remanded the case to Senior U.S. District Judge Jeffrey S. White of Oakland to “rigorously evaluate the actual benefit provided to the class and award reasonable attorneys’ fees considering that benefit.”
