Tesla cross-complaint against state civil rights agency can proceed

Judge Evelio Grillo clarified that Tesla’s fifth cause of action relating to the department’s alleged practice of asking parties to waive certain rights in an investigation survived his April 20 order in which he sustained a demurrer to the other causes of action.

An Alameda County judge allowed Tesla, Inc.’s cross complaint against the California Civil Rights Department for alleged “underground regulations” in its investigations of employers to move forward Wednesday.

The lawsuit originated from a February 2022 complaint filed by the department alleging numerous instances of racial discrimination at Tesla’s Fremont factory, including segregation and harassment.
