Alleged metals in baby food case remains in witness battle
Both sides are gearing up for a jury trial over allegations that baby food produced by Gerber and six other companies contains large quantities of heavy metals.
A Los Angeles judge on Tuesday denied a motion to compel Gerber baby food company to recall a witness to testify about neurotoxic effects of heavy metals and their relationship to early development brain damage.
“Bottom line is I’m denying the motion,” Superior Court Judge Lawrence P. Riff said. “I just don’t think there is a necessity, a reasonable necessity for more time with this witness under oath under the totality of the circumstance...
