Amazon’s knowledge of patent doesn’t apply to subsidiaries

BSD Crown Ltd. alleged that despite Amazon’s prior knowledge, its subsidiaries Amazon Web Services Inc. and Twitch Interactive Inc. implemented the technology in products that infringed upon the patent. But that argument did not persuade the judge.

Finding that Amazon’s knowledge of a patent does not mean its subsidiaries also knew, a federal judge in San Francisco said Wednesday he will dismiss claims against the technology giant with leave to amend.

The case involves a patent for broadcasting technology that allows transmission of audio and video as well as automatic video quality changing based on how strong someone’s internet connection is.
