Volkswagen wins summary judgment on updates to ‘defeat devices’

U.S. District Judge Charles R. Breyer said Volkswagen's software updates to the devices that were meant to cheat on emissions did not violate the plaintiffs' regulations and in fact emissions were reduced.

A federal judge in San Francisco granted Volkswagen summary judgment on claims from two counties in a multidistrict lawsuit stemming from a 2015 investigation by the Environmental Protection Agency into “defeat devices” in nearly 500,000 vehicles meant to cheat emissions standards.
