Judge shortage cited in freeing of machete attacker
“I fear the opinion could be read to suggest that all that is needed to support the trial court’s finding here is that the county’s courts are severely underfunded,” 4th District Court of Appeal Justice Michael J. Raphael wrote in a separate concurrence.




A Court of Appeal panel upheld the dismissal of assault charges against a man accused of a machete attack, saying Riverside County’s lack of judges unlawfully delayed a trial although the district attorney was ready to proceed.
One justice on the panel concurred, but said a lack of judges should not be relied on as the only justification; courts should take additional measures.
