Circuit hears doctors’ challenge to COVID law
The 9th Circuit heard consolidated challenges to AB 2098, which declares “the dissemination of misinformation or disinformation” by doctors about the virus is “unprofessional conduct” subject to professional discipline.




Attorneys for doctors and the state sparred over whether there is a scientific consensus on COVID treatment and prevention during arguments Monday at the 9th U.S. Circuit Court of Appeal.
The doctors’ attorneys said their free speech rights were violated by a 2022 California law, while a deputy attorney general warned that a ruling against the state would allow doctors to tell patients whatever they want, even if it is not true.
