Local government workers can solicit campaign money from coworkers, 9th Circuit rules

Two Santa Clara County deputy public defenders sued the state after they were warned against soliciting political contributions from co-workers for the campaign of their colleague, Sajid Khan, who was running for district attorney in 2022

A 9th U.S. Circuit Court of Appeals panel ruled Wednesday that city and county government employees can solicit campaign contributions from their co-workers, just as state employees can, because the disparate treatment violates the First Amendment.

“We do not doubt the State’s interests in combating corruption and worker coercion,” wrote Senior 9th Circuit Circuit Judge Marsha S. Berzon, an appointee of President Bill Clinton.
