9th Circuit OKs limits on employers’ COVID liability

"It was obvious from the opinion that the 9th Circuit was pleased with the thoroughness of the response from the Supreme Court," William A. Bogdan of Hinshaw & Culbertson LLP said.

The 9th U.S. Circuit Court of Appeals affirmed Tuesday the state Supreme Court’s ruling that employers have no duty of care to prevent the spread of COVID-19 to their employees’ households, creating precedent that clarified the scope of employers’ tort liability for the spread of the coronavirus.
