Judge reverses self, grants studio demurrer against director in debt dispute

After expressing skepticism in his tentative order about Morgan Creek Productions’ argument that a debt acknowledgment form is not a contract, a Los Angeles judge granted the studio’s demurrer, allowing the debtor director to amend his cross complaint.

A movie studio accusing director Antoine Fuqua of misappropriating over $1 million in loans successfully demurred to counter claims that he was tricked into signing a debt acknowledgment form, according to a Los Angeles judge’s ruling on Friday.

Throwing out his tentative decision to overrule the demurrer, Judge Randolph M. Hammock granted it, and gave Fuqua leave to file an amended cross complaint.
