State asks 9th Circuit to revive law on children’s online data

The state is appealing a September ruling by U.S. District Judge Beth Labson Freeman of San Jose, granting a preliminary injunction against the law – set to go into effect in July 2024 – sought by a technology industry group.

The state attorney general’s office told the 9th U.S. Circuit Court of Appeals that a district court judge was wrong in enjoining a California law aimed at regulating the storage and processing of children’s online data on the basis that the statute violated free speech.
