State Bar to seek protective order if liability case moves forward

Attorneys for the State Bar said they anticipate a protective order to be necessary during the discovery process of a class action over alleged responsibility for disbarred lawyer Tom Girardi’s misconduct if their demurrer on grounds of jurisdiction and liability is overruled.

Attorneys representing the State Bar in a proposed class action that would hold the agency liable for Tom Girardi’s misconduct told a judge Thursday they will challenge the adequacy of the proposed plaintiff class representatives and liability claims in a demurrer.
