Google may be unable to compel arbitration in wiretapping case, judge says

Google’s attorneys, who are from Perkins Coie LLP, asserted that absent members of the class agreed to arbitrate their claims and should be excluded from the certified purchaser class.

A federal judge said that it may be too late for Google to compel absent members of a class to arbitrate a case that claims illegal wiretapping via Google Assistant.

In a motion to compel hearing Thursday, Google LLC attorneys argued they could not bring the motion until a class was certified and absent class members were determined. Plaintiffs’ counsel argued Google has waited too long and waived their right to compel arbitration.
