Plaintiffs not specific enough in asbestos fraud case, judge rules

“The complaint contains no specificity about the specific false statements that defendant allegedly made to plaintiffs or the specific information plaintiffs concealed or how defendant was involved in the vast conspiracy,” L.A. Superior Court Judge Laura A. Siegle wrote in her ruling.

A Los Angeles County judge denied Friday a summary judgment motion from attorneys representing Dunn-Edwards Corp. in an asbestos exposure liability case, but granted summary adjudication on a fraud claim due to a lack of specificity from the plaintiff couple.

Counsel for the plaintiffs argued the paint company knew its paint contained the hazardous fibers but never issued warnings and sold the product anyway.
