Bill to strengthen prison assault penalties moves forward

The bill’s author, Assemblyman Freddie Rodriguez, D-Pomona, said this closes a loophole in the law that sometimes exempted staff found to have engaged in consensual sexual contact with inmates.

Responding to a wave of prison sexual assault cases, on Tuesday lawmakers advanced a bill to strengthen penalties against staff who assault inmates. But critics say the bigger problem may be district attorneys who are reluctant to prosecute these crimes.

AB 1039 clarifies the definition of “sexual activity” in the Penal Code. It also mandates that anyone “employed by a public entity detention facility or a public health facility” convicted...
