Sen. Umberg’s legislation is a step towards fixing a gaping hole in the judicial system caused by ADR
ADR has become a forced remedy for consumers, homeowners, and medical patients, resulting in a perversion of our judicial system. Former judges are lured away by the promise of increased income, and arbitrators are empowered to act arbitrarily, resulting in little accountability.
Senator Tom Umberg’s proposed legislation, SB940, is a powder puff, not a sledgehammer. But it does expose a gaping hole in our judicial system. The hard fact is that ADR has replaced, in too many cases, the protections afforded by our judicial system. ADR is no longer a chosen remedy among equals, wealthy businesses who wish for an allegedly speedy and less expensive result; ADR has now been forced upon the population in general, consumers...
