State law allowing subdivision ruled unconstitutional

A group of charter cities had challenged the law, claiming it unlawfully encroached on their planning powers.

A state law allowing property owners to subdivide land into two lots and build up to two homes on each lot has been ruled unconstitutional in a decision handed down by the Los Angeles County Superior Court.

The ruling stems from a lawsuit filed by the cities of Redondo Beach, Carson, Torrance, Whittier and Del Mar filed in March 2022 claiming that Senate Bill 9 usurped the authority of charter cities to regulate housing.
