Overbilling refunds should nix class action for damages, Apple says
In a motion to dismiss, Apple said the claims are inadequately and implausibly pled, if not barred outright because two of the four lead plaintiffs received refunds for the overbilling and the other two cannot prove Apple was aware of the billing error.




Apple Inc. asked a federal judge in San Jose to dismiss a putative class action accusing the tech company of fraudulently charging customers for their Apple Care + device maintenance subscriptions after they traded in their device.
