Smoke shop association sues Fresno over new zoning rules

The law, set to take effect June 5, caps the number of shops allowed to operate and imposes what plaintiffs call "onerous" new requirements.

A trade association representing smoke shop owners sued the City of Fresno over a new ordinance they say violates their due process rights.

The California Smoke Shops Association says the law will require them to get conditional use permits, forcing all to shut down temporarily and some permanently. They also claim the rules are onerous because they single out specialty shops but do not affect convenience stores that sell cigarettes along with a variety of other products.
