Cities accuse Baykeeper of allowing evidence spoliation in pollution trial

Sunnyvale and Mountain View accuse San Francisco Baykeeper of allowing a lab to destroy data in a Clean Water Act trial, seeking sanctions for prejudiced defenses in a sewage pollution case.

Two cities in the middle of a trial over claims they discharged raw sewage and stormwater polluted with bacteria into local waterways in Santa Clara County have accused the plaintiff of allowing a lab to destroy evidence.

The cities of Sunnyvale and Mountain View have accused environmental group San Francisco Baykeeper of allowing destruction of the underlying data for exhibits to be used in the Clean Water Act lawsuit, following witness testimony about evidence at trial.
