Hospital group's suit against Anthem dismissed, appeal planned

California Hospital Association's lawsuit against Anthem Blue Cross for delayed post-acute care was dismissed without prejudice. The association plans to appeal, citing violations of California's Knox-Keene Act.

Claims that Anthem Blue Cross failed to arrange timely, post-acute care for its members were dismissed without prejudice after months of delay and a dispute over whether further claims could be filed.

Los Angeles Judge Timothy Patrick Dillon signed a judgment on Monday granting Blue Cross' demurrer to the case without prejudice but modifying an earlier ruling by Judge Kenneth Freeman that dismissed the case in its entirety.
