Judge denies class certification in Apple data lawsuit

A federal judge denied class certification for iPhone users suing Apple, citing "fading memories" and lack of device settings data in a case alleging unauthorized cellular data use.

Saying a lawsuit's deficiencies were "uncurable," a federal judge in San Jose denied class certification Wednesday to millions of iPhone customers who accused Apple of fraudulently using their cellular data without permission when they upgraded to iOS 13.

U.S. District Judge Edward Davila ruled that "fading memories" of potential class members made the plaintiffs' case difficult to prove.
