Chief Justice says jury trial right ends at California court door

The California Supreme Court ruled that forum selection clauses are enforceable even if they require litigation in jurisdictions like Delaware that don't provide jury trials, reversing two lower court decisions.

A minority shareholder cannot block a move to Delaware Chancery Court even though that court operates by rules impermissible in California, a unanimous California Supreme Court has ruled. The court found the defendant in the underlying lawsuit could move the case to Delaware, where it would go before a panel of judges rather than a jury.
