Ontrak CEO cites flawed jury instructions, seeks reversal

Former Ontrak CEO Terren Peizer seeks to overturn his insider trading conviction, arguing the jury lacked key intent instructions. His appeal challenges a first-of-its-kind prosecution under Rule 10b5-1.

In a first-of-its-kind securities fraud case, an attorney for the former CEO of health care company Ontrak Inc. contends missing jury instructions that would have clarified intent are likely to reverse his insider trading conviction.

If Terren Peizer "prevails on appeal on these issues, the proper remedy is reversal or a new trial," King & Spalding LLP partner David K. Willingham wrote for the CEO defendant in a post-trial brief Tuesday.
