Edison motion to strike in billing case 'frivolous,' LA judge says
A Los Angeles judge rejected Edison's demurrer and motion to strike in a back-billing class action, calling arguments "frivolous," allowing plaintiffs to pursue exemplary damages.
A Los Angeles County judge has deemed Edison's arguments and authorities "frivolous" in its attempt to eliminate a consumer lawsuit over catch-up bills sent to 50,000 customers months after charges were allegedly incurred.
The judge overruled Edison's demurrer and denied its motion to strike, keeping alive allegations of willful disregard of the law that may bring punitive damages.
