Judge rules used Audi buyers can't claim lemon law protections

Orange County Superior Court Judge Bradley Erdosi granted summary judgment to Volkswagen Group of America, finding that buyers of a pre-owned 2021 Audi Q7 failed to show the SUV qualified as a "new motor vehicle" under California's Song-Beverly Act.

An Orange County Superior Court judge sided with Volkswagen Group of America in a used auto lemon law case, ruling that buyers of a pre-owned 2021 Audi Q7 failed to prove the SUV qualified as a "new motor vehicle" under state law.

The ruling applied the California Supreme Court's landmark decision in Rodriguez v. FCA, signaling tougher hurdles for consumers pursuing Song-Beverly Act claims over used vehicles sold with remaining factory warranties.
