On Oct. 11, California enacted SB 37 to crack down on misleading attorney advertising -- giving consumers the right to sue over deceptive ads and strengthening penalties for illegal solicitation.

Take a drive on just about any major highway in California, and you're bound to see them: massive billboards bought up by personal injury lawyers dotting the side of the roadway. Promises to "fight for you" and to "get you paid!"

Lawyer advertising in California -- and nationwide -- was historically prohibited under state bar rules, which treated it as unprofessional "solicitation." In many circles, the idea of lawyers advertising was frowned upon.
