Firm sanctioned $1.4M for 'frivolous suit, evidence manipulation'
U.S. District Judge Vince Chhabria found Womble Bond Dickinson and ALC Medical Holdings willfully continued a meritless case over a device designed to prevent postpartum hemorrhages, allegedly doctoring images to falsely suggest a key patent feature was present in the competing product.
A federal judge sanctioned a law firm and its client $1.4 million for bringing a frivolous patent and false advertising claim for a medical maternity device, as well as manipulating evidence in a lawsuit where less than $1 million was at dispute.
The sanctioned law firm, Womble Bond Dickinson (US) LLP, denies manipulating any evidence and said at a sanctions hearing Friday that they plan to appeal the order.
