9th Circuit to revisit ammo background-check law in high-stakes en banc review
After a three-judge panel struck down California's ammunition background-check requirement, the 9th Circuit has voted to rehear the dispute before an en banc panel, raising questions about how the court's ideological alignment will shape one of its most consequential Second Amendment rulings.
The question of whether a California law that requires firearm owners to complete background checks before each ammunition purchase is constitutional will be decided in March by a 9th U.S. Circuit Court of Appeals en banc panel.
And as with all Second Amendment cases before the appellate court, the outcome will probably come down to the luck of the draw, according to Arthur D. Hellman, a professor emeritus at the University of Pittsburgh School of Law.
