6th District upholds Santa Clara County's emergency declaration for sales tax
The appellate court found county supervisors had a reasonable basis to declare an emergency and place the five-year sales tax on a 2025 special-election ballot, but a separate constitutional challenge to the tax remains pending.
The 6th District Court of Appeal handed Santa Clara County a victory Wednesday in its effort to defend a five-year sales tax approved by voters last year to help offset federal funding cuts to health care and other safety-net services.
The court affirmed a lower court ruling upholding the Board of Supervisors' declaration of an emergency, which allowed the county to place the 0.625% sales tax on a November 2025 special-election ballot.
