Discovering Trouble

E-Discovery is a major pain for most companies today. But for some it's getting even worse, according to a 2008 report from Deloitte. Changes in discovery rules and the complexity of producing electronic information are largely to blame, indicates its survey of 144 attorneys and executives from large- and medium-size U.S. companies across a variety of sectors. Here is a sampling of statements from the survey, along with the percentage of respondents who agreed.

33% - Responding to discovery requests has become significantly more complex during the past year.

30% - My company has no formal policies and procedures in place regarding legal holds.

30% - Responding to discovery requests has become more costly during the past year.
