998 offers in arbitration: Know the law or forfeit your costs
On Monday, the California Supreme Court held that, notwithstanding defendant’s timely submission of a request for costs under California Code of Civil Procedure Section 998 to the arbitrator, and notwithstanding the arbitrator’s authority to award costs, defendant cannot recover his costs because the arbitrator erroneously thought he lacked the jurisdiction to award them.
