SANTA ANA -- For U.S. District Judge Cormac J. Carney, finding California's use of the death penalty unconstitutional was easy. He knew condemned inmates were spending decades in prison. He knew how few had been executed, and he knew how few attorneys were qualified to represent them. He also knew the testimony of a man who in addition to never seeing his murdered daughter grow up, knew he'd never see her killer executed, either.
